Market Me coaching T&Cs

  1. Coaching Service Terms


1.1. The terms and conditions below apply to all coaching provided by Market Me coaching (MMc) to any individual or organisation (“the client”) and will make up the contract for the service to be provided by MMc for the client. The term ‘coaching’ as here used covers all services (outlined below) as applicable delivered to the client by MMc clients.

1.2. In return for the fees payable by the client (or by a third party on their behalf), MMc agrees to provide the service as described below and in accordance with the terms and conditions set out below. The client agrees to pay fees for the service on the terms and conditions set out below (in situations where a third party pays the fees, the third party counts as an agent acting on behalf of the client).

1.3. The date that the first coaching session takes place shall be deemed to be the start date for the service. Where any client is unhappy with any of the terms and conditions they can contact MMc to discuss any concerns and see if they can be resolved before the first coaching session. Participation by any individual in the first coaching session constitutes acceptance of these terms and conditions.

  1. Terms and Conditions – Service to be provided


2.1. Marketing Coaching

The Marketing Coaching service will be provided in accordance with the details given by MMc unless otherwise agreed between MMc and the client. Invoices can be provided on request. 

2.2. Format of Sessions:

2.2.1. Format of Sessions: Telephone coaching, face-to-face coaching or Skype coaching as agreed between MMc and the client.

Unless otherwise agreed, the client is responsible for telephoning MMc at agreed times. MMc is responsible for ensuring that she is available for consultation at agreed times.

2.2.2. Length of Each Session: Each coaching session last one hour and thirty minutes.

2.2.3. Initial Number of Sessions to be provided: To be agreed between MMc and the client. MMc will confirm this together with the breakdown of the services MMc will provide to the client via email. Where no specific number of sessions is agreed, sessions will be provided on a session by session basis at the full cost of £150.00 unless otherwise agreed by MMc and the client and confirmed by email.

2.2.4. Per Session Fee: In accordance with MMc current per session fee or fee for a programme of sessions, or any other such fee as shall be agreed and notified to the client. MMc will confirm the fee in writing (email). A valid email address must therefore be provided to MMc at the beginning of the working relationship.

2.2.5. Number of sessions for which payment is required in advance: All sessions must be paid for up front 7 days in advance of the first session taking place. MMc will provide a receipt to the client upon payment.

  1. Additional Sessions


3.1. MMc may agree to provide additional coaching sessions after completion of the initial agreed session(s). These terms and conditions will apply to any additional sessions so provided and the Per Session Fee will remain the same as originally agreed except where MMc notifies the client in writing by e-mail of a change to the Fee or to any other term or condition.

  1. All Forms of Coaching


4.1. Dates and Times of Sessions


4.1.1. The date and time of the first session and any subsequent session will be agreed between MMc and the client by phone or email and confirmed by MMc by email or letter.

4.1.2. Sessions can only be rearranged in accordance with the section in these terms and conditions headed “Rearranging Sessions”.

4.2. Payment Terms


4.2.1. Fees will need to be paid via bank transfer to MMc bank account. Details will be provided to clients via email. Where receipts are requested by the client, they will be sent by e-mail.

4.2.2. Fees are payable in advance of each coaching session unless otherwise agreed. Where payment has not been received by MMc 7 days in advance of a coaching session MMc is not obliged to provide the session.

4.3 Between Sessions


4.3.1. MMc may assign the client tasks or exercises to complete between coaching sessions. There is no obligation on the client to complete these items of ‘homework’, but not doing so may slow the client’s progress in achieving desired business or personal outcomes.

4.3.2. Where possible, clients are requested to submit any information requested by MMc relating to assignments at least 24 hours before the coaching session when they are to be discussed. MMc will provide feedback on completed assignments during coaching sessions.

4.3.3. The client may contact MMc by phone or e-mail between sessions to seek clarification regarding anything arising from a coaching session or for administrative purposes (e.g. where a client needs to rearrange a coaching session or make a payment).

4.3.4. Additional coaching can also be provided between sessions but there will be an additional charge for this as set out in Fees. MMc will always advise a client in advance if the nature of a client’s contact is likely to incur an additional charge and no such charges will be imposed without the client’s agreement.

4.4. Rearranging Sessions


4.4.1. If a client needs to rearrange a coaching session, they should provide at least 48 hours notice. No refunds will be given to clients for unused coaching sessions unless 48 hours notice has been given. In exceptional circumstances MMc may need to rearrange a coaching session. In those instances she will also give the client 48 hours notice where practical.

4.4.2. If MMc needs to rearrange a coaching session this can be booked as applicable by the client. If there is no further suitable dates in which the client could use the session within 6 months of the coaching session to be rearranged then MMc will refund the money. There are to be no previously booked sessions within that 6 months otherwise the 6 months applies after the last booked coaching session date.

4.4.3. Where a client pays for a session or sessions in advance they must have the coaching session(s) that they have paid for within 6 months of the payment or their fee is forfeited.

  1. Confidentiality

5.1. Personal information or business information supplied by clients in coaching sessions will be treated as confidential. It will not be disclosed to a third party without the client’s prior permission, save where required by law or where action might be necessary to prevent harm to the client or someone else.

  1. Guarantee


6.1. Any client who is dissatisfied with any coaching session is required to speak to MMc within 1 week of any coaching session. It is then between MMc and the client to see if the problem can be resolved. MMc will provide a free consultation session to any client who is dissatisfied to ensure that the problem is remedied.

6.1.1 The fee coaching session will be booked at a time that is suitable for both MMc and the client. It will not exceed one hour and thirty minutes and MMc will provide a full report to the client.

6.2. If after the free coaching session the client is still dissatisfied then the client can ask for a full refund for the particular session they were dissatisfied with. This refund will be given, provided that the request for a refund has been made within four weeks of completion of the coaching session regardless of when the free consultation is booked if within the four weeks. If the free consultation is after the four weeks, then the client has a further two weeks after the free consultation to request a refund in writing (email).

6.3. If the client is seeking a refund then they are required to put this in writing (email) outlining their reasons for the dissatisfaction. If a client obtains a refund for a coaching session in accordance with this clause, then the client and MMc each have the option to terminate this contract immediately, confirming such termination by email. If either party does terminate this contract in such circumstances then MMc will have no obligation to provide any further coaching sessions to the client and the client will in turn will be entitled to a refund for any future coaching sessions for which they have already paid which are no longer to be provided.

  1. Early termination

7.1. In exceptional circumstances, such as illness or unavailability due to bereavement or other commitments, inappropriate behavior by the client, actual or potential conflict of interest, or other reasons, MMc can decide to terminate the service to the client early or refuse or be unable to provide further coaching sessions to the client. In such a circumstance the client will be given reasonable notice of termination by MMc where practicable and will be refunded any advance payments made for coaching sessions not yet provided.

7.2. The client is entitled to terminate the service early at any time by giving written notice by email, whether or not they are using the “Guarantee” clause above. Such notice will take immediate effect as soon as MMc receives it. In such a circumstance the client will be entitled to a full refund for any coaching sessions already paid for but not yet provided to the client and you will not be required to make any payment for coaching sessions not yet provided to the client.

  1. Responsibilities

8.1. MMc will seek to enable the client to improve their quality of life or level of business success and to achieve their desired outcomes. Remarkable results can be achieved where clients follow a clear plan in a committed way. However, the client has sole responsibility for taking important decisions in their life or business. MMc has no liability for any loss incurred by any client, whether financial or otherwise, following commencement of coaching sessions, or for any perceived failure by the client, whether justified or otherwise, to achieve a material improvement in quality of life or business or to achieve their desired outcomes or goals.

8.2. It is the responsibility of the client to clearly define such outcomes or goals to MMc before embarking on any coaching sessions to ensure that both MMc and the client have these in mind when working together. As in 8.1. MMc takes no liability for any loss to your company or personal circumstance; however, wishes to work with you positively to make the most of the sessions you do have together.

  1. Variation of Terms and Conditions


9.1. Where an Initial Number of Sessions is agreed, any changes to these terms and conditions intended to take effect prior to the conclusion of those Initial Number of Sessions will only have effect if agreed by both MMc and the client and confirmed by MMc in writing by email. In other cases, MMc may change any of these terms or conditions including the Per Session Fee by giving the client one week’s notice in writing by e-mail of the change(s). If following receipt of such notification of change, the client no longer wishes to proceed with further coaching sessions, they may withdraw from the service immediately by giving notice in writing by email and they will then be entitled to a full refund of any fees paid in advance for coaching sessions not yet provided. Such notice will be effective on receipt by MMc.
